The Nelson Mandela Bay Municipality have introduction their new Land Use Scheme. Now, there is no such thing as a granny flat, or flatlet. In the previous PE Zoning Scheme, a flatlet less than 50 m2 was regarded as a granny flat and required municipal consent. If over 50 m2, it was regarded as a second dwelling. This required special consent, which included obtaining neighbours approval and a town planning application.
In the new scheme, for a second dwelling, an owner doesn’t have to obtain neighbours approval. A second and even a third dwelling can be developed without special consent.
There are conditions and a property owner should consult a property professional for advice, before proceeding with new construction, or converting part of their existing home, into a second dwelling.
